LEGAL PROGRAM
Mid-Shore Council on Family Violence (MSCFV) Legal Program is designed to provide assistance through the judicial system for victims of domestic violence. Services are free or reduced fee and are confidential. The program consists of two components; Advocacy & Accompaniment and Direct Representation.
LEGAL OPTIONS
The Police and the Criminal Court System
The Civil Court System and Protective Orderss
ADVOCACY AND ACCOMPANIMENT
MSCFV's Legal Advocates can provide information and explain options available to victims of domestic violence. If a victim decides to pursue any of their legal options, an advocate can assist with completing applications, court preparation and support throughout the proceedings. Legal Advocates make referrals for Direct Representation on behalf of their clients.
DIRECT REPRESENTATION
There are several ways in which a victim of domestic violence can receive direct legal representation through the Mid-Shore Council on Family Violence.
MSCFV has received a grant from the Administrative Office of the Courts which allows us to provide legal representation for victims of domestic violence at their final protective order/modification hearings. MSCFV also has received a Minority Business Employer Grant and through this grant an agreement has been made with a local attorney's office for representation at final protective order and modification hearings.
MSCFV received two grants from Maryland Legal Services Corporation to provide direct representation to low-income victims of domestic violence for divorce and/or custody related cases. The legal grant is not available for criminal representation. A victim must meet financial requirements and complete an Income Affidavit as well as an Intake Form and if eligible, is referred to an attorney. The attorney has agreed to represent the client at a reduced fee of fifty dollars ($50) per hour. MSCFV pays at least the first ten hours ($500) and possibly more, depending on the case. When the $500 has been expended the client is responsible for paying their attorney at the reduced fee rate.
